The Fertility House Legal Disclaimer
The Fertility House is a Nursing Corporation whose goal is to undertake and review potential surrogates’/gestational carriers’ medical records and histories as a third-party consultant. The Fertility House does not guarantee the acceptance or the denial of any surrogate on behalf of a designated participating fertility center. The Fertility House is providing a professional review based on educational experience and professional training; it is not intended to be medical advice or an opinion. The Fertility House is not responsible for the failure of any surrogate/gestational carrier candidate to be chosen by an intended parent or fertility center after medical records have been reviewed and a formal summary statement has been provided in the form of the Medical Record Review and Summary Statement document. Candidates should continue to be presented to other inquiring intended parents and fertility centers.


The terms surrogate and gestational carrier by definition have similarities but are different; for all intended purposes and for the purposes of screening legal medical documents, a surrogate and a gestational carrier are considered the same.


Upon a request to review medical records, all records for each pregnancy (including but not limited to all applicable prenatal, intranatal, and postnatal records) must be obtained and presented for review. Additional documents may be requested at any time during the review process. The surrogate/gestational carrier will be required to have a one-time phone consult with The Fertility House; the intent of the phone consult is for clarification purposes only.


Once all medical records have been sent to The Fertility House, payment must be collected prior to release of any final documentation including, but not limited to, the release of the Medical Record Review and Summary Statement.


Once Fees are collected, The Fertility House will work diligently to provide the Medical Record Review and Summary Statement in a time-sensitive manner of one to two weeks from the date stamped by original payment. A rush review can be requested for an additional fee.


If paper charts are obtained, they are the property of the surrogate/gestational carrier and will be returned at a later date or shredded in an acceptable manner. If records are to be returned, it will be at the cost of the agency or the original owner. All medical records will be kept confidential and released only with signed permission.


The Fertility House summary statement entitled Medical Record Review and Summary Statement expires after one year from its originating date or in the event of medical changes incurred by the surrogate/gestational carrier. In this case, an addendum can be provided for additional fees. The originating date to determine expiration can be found on the signature line of the original report.


All information about an inquiring intended parent, surrogacy agency, or surrogate/gestational carrier is considered confidential. Said surrogate/gestational carrier demographic and surrogacy agencies and their representatives may be referenced for statistics only to enable the growth of The Fertility House. Names will not be used.


The surrogate agency, the surrogate/gestational carrier, and the intended parent(s) release The Fertility House from all liability if the surrogate/gestational carrier is not accepted or is rejected from the fertility center for any reason. No guarantee of selection by intended parents or fertility center is being provided and no inference to the contrary should be made.


The Fertility House is not affiliated with said fertility center, said surrogacy agency, or said surrogate(s)/gestational carrier(s). The Fertility House holds no underlying alternative motive to the acceptance or denial of a surrogate candidate.


The Fertility House honors to compile a trustworthy, competent, medical, and professional summary report entitled the Medical Record Review and Summary Statement regarding a surrogate’s/gestational carrier’s medical records. This report is provided for informational purposes only. Nothing presented therein is intended to constitute medical advice, and under no circumstances should any information provided therein be used or considered as a recommendation to take any particular course of action. Information provided reflects the culmination of stated facts found within said medical records and a one-time phone consultation with the potential surrogate/gestational carrier to confirm the facts found within her medical records. While The Fertility House has used reasonable efforts to obtain information from reliable sources, we make no representations or warranties as to the accuracy, reliability, or completeness of any third-party information presented therein. Unless otherwise noted, the medical records summary contained therein are based on The Fertility House’s analysis. We remind you that such information must be treated as confidential information, and may not be reproduced, used, or disclosed without our prior written consent.
